I am currently completing a book on what I call ‘the global model of constitutional rights’. In the last decades, constitutions and constitutional courts, first in Europe and now around the world, have employed approaches to constitutional rights law which are, at a structural level, strikingly similar: there is a trend towards an extremely broad understanding of prima facie rights, including a broad right to privacy, horizontal effect, positive obligations, and, increasingly, socio-economic rights; and at the justification stage, the doctrines of balancing and proportionality are used to determine whether an interference with a prima facie right is justified. My claim is that the global model is based on a coherent conception of constitutional rights which connects to attractive philosophical accounts of judicial review, democracy and the separation of powers.

Kai Moller joined LSE as a Lecturer in Human Rights Law in 2009. From 2007-9 he was a Junior Research Fellow in Law and previously a Lecturer in Jurisprudence at Lincoln College, Oxford, where he taught Comparative Human Rights, Jurisprudence and Constitutional Law. He holds a PhD in law from Freiburg University and an M.Jur. and M.Phil. from Oxford. He is also qualified for the German Bar.
