Dr Kai Möller has written an article for Germany's leading newspaper, Süddeutsche Zeitung, on the controversial question of whether the introduction of same sex marriage in Germany that was passed by the Bundestag last week requires an amendment to the Constitution.
Dr Möller argues that Article 6 of the Basic Law, which protects marriage, should be interpreted in line with the fundamental values of the Constitution, namely human dignity, freedom, and equality. This leads him to conclude that same sex marriage is not only permissible but obligatory under the Basic Law.
