Jonathan Fisher KC, Visiting Professor in Practice at LSE Law School, was recently interviewed in The Times following his new appointment chairing the upcoming Government's Independent Review into the Disclosure Regime and Fraud Offences which he describes as a “daunting but exciting task”. Before the introduction of the Criminal Procedure and Investigations Act 1996, Jonathan explains there was a concern that innocent people were being convicted through failures to disclose key material that could help their defence. Today, he suggests, this concern has switched amid fears that potentially guilty people are being acquitted because of the demands of the disclosure regime in a digital age.
