An article by Dr Richard Martin was recently cited with approval by the UK Supreme Court, in this judgment on the correct test for self-defence in police disciplinary proceedings. At [85] the Court stated: “In formulating our judgment and in particular this part of our judgment, we have found great assistance from an article by Assistant Professor Richard Martin entitled “When Police Kill in the Line of Duty: Mistaken Belief, Professional Misconduct and Ethical Duties After R. (W80)” [2021] Crim LR 662 at p666.
